Special guarantees for Salmonella

The legal basis:

  • Article 8 of Regulation (EC) No 853/2004 of 29 April 2004 laying down specific hygiene rules for food of animal origin
  • Regulation (EC) No 1688/2005 of 14 October 2005 implementing Regulation (EC) No 853/2004 as regards special guarantees concerning salmonella for consignments to Finland and Sweden of certain meat and eggs
  • Commission Regulation EU 427/2012 concerning the extension of special salmonella guarantees to eggs intended for Denmark. Hereby, eggs imported from Denmark to Finland are not concerned by the demands mentioned in (EC) No 1688/2005. This means that the special garantees for salmonella DO NOT apply to consignments of eggs imported from Denmark to Sweden,
  • Comission Regulation EU 2018/307 extending the special guarantees concerning Salmonella spp. laid down in Regulation EC 853/2004 of the European Parliament and of the Council to meat derived from broilers (Gallus gallus) intended for Denmark. This means that the special garantees for salmonella DO NOT apply to consignmnts of meat derived from broilers (Gallus gallus), imported from Denmark to Sweden)
  • EFTA Surveillance Authority Decision 1/19/COL extending the special guarantees concerning Salmonella spp. laid down in Regulation EC 853/2004 of the European Parliament and of the Council to meat and eggs of domestic fowl (Gallus gallus), and meat derived from turkeys intended for Iceland to meat derived from broilers (Gallus gallus). This means that the special garantees for salmonella DO NOT apply to consignments of meat and eggs of domestic fowl (Gallus gallus), and meat derived from turkeys imported from Island to Sweden)
  • The Swedish Food Agency (SFA) regulations (LIVSFS 2005:22) on intra-community trade in food of animal

Article 8 of Regulation (EC) No 853/2004 states the following:

  1. Food business operators intending to place the following food of animal origin on the market in Sweden or Finland shall comply with the rules set out in paragraph 2 in respect of salmonella:
    (a) meat from bovine and porcine animals, including minced meat but excluding meat preparations and MSM;
    (b) meat from poultry of the following species: domestic fowl, turkeys, guinea-fowl, ducks and geese, including minced meat but excluding meat preparations and MSM; and
    (c) eggs.

Meat

Article 2. (a) of Regulation (EC) No. 853/2005 states the following: In the case of meat from bovine and porcine animals and meat from poultry, samples of consignments shall have been taken in the dispatching establishment and been subjected to a microbiological test with negative results in accordance with Community legislation.

Eggs

Article 2. (b) of Regulation (EC) No. 853/2005 states the following:

In the case of eggs, packing centres shall provide a guarantee that consignments originate from flocks that have been subjected to a microbiological test with negative results in accordance with Community legislation.

(f) In the case of eggs, a certificate stating that the tests referred to in subparagraph (b) have been carried out with negative results, or that the eggs are destined to be used in the manner referred to in subparagraph (c), must accompany consignments.

Article 2. (c) of Regulation (EC) No. 853/2005 states the following:

In the case of meat from bovine and porcine animals, the test provided for in subparagraph (a) need not be carried out for consignments intended for an establishment for the purposes of pasteurisation, sterilisation or treatment having a similar effect.

In the case of eggs, the test provided for in subparagraph (b) need not be carried out for consignments intended for the manufacture of processed products by a process that guarantees the elimination of salmonella.n the case of eggs, packing centres shall provide a guarantee that consignments originate from flocks that have been subjected to a microbiological test with negative results in accordance with Community legislation.Importers of hen eggs for consumption must, as part of the inhouse-control, ensure that the consignment is accompanied by a certificate of salmonella testing in accordance with Commission Regulation (EC) No 1688/2005 before further processing of the eggs.

Eggs need not be tested if the consignment is delivered to an approved establishment and when it can be demonstrated that they are to be used in the manufacture of egg products.
